Terms of Service

These Terms of Service ("Terms") govern your use of the Plexen website and services provided by PlexenAI ("Plexen," "we," "us," or "our"). By purchasing a package or using our services, you agree to these Terms.

1. Services

Plexen provides custom website design, development, CRM integration, and ongoing managed platform services for businesses. The scope of each engagement is determined by the package tier and add-ons selected at checkout.

2. Payments

Year 1 Package — a one-time upfront payment covering your website build, CRM setup, and first year of hosting and management.
Managed Platform Retainer (Year 2+) — a recurring monthly or annual fee covering hosting, security monitoring, software updates, CRM access, uptime management, and support.
Add-ons — optional monthly services billed alongside your retainer.

All payments are processed securely through Stripe. Prices are in USD unless otherwise stated.

3. Refund Policy

Due to the custom nature of our work:

Upfront build fees are non-refundable once work has commenced.
Monthly retainer and add-on fees may be canceled with 30 days' written notice.
If you are unsatisfied with deliverables, contact us within 14 days and we will work to resolve the issue.

4. Client Responsibilities

Provide accurate business information and content in a timely manner.
Review and approve deliverables within agreed timelines.
Maintain the confidentiality of account credentials.

5. Intellectual Property

Upon full payment, you own the custom website and content we create for you. Plexen retains the right to use general techniques, frameworks, and anonymized examples in future work and marketing.

6. Hosting & Uptime

We host your website on enterprise-grade infrastructure (Vercel / Cloudflare). While we strive for maximum uptime, we do not guarantee 100% availability and are not liable for downtime caused by third-party providers or force majeure events.

7. Limitation of Liability

Plexen's total liability for any claim arising from our services shall not exceed the total amount you have paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate the engagement with 30 days' written notice. Upon termination, we will provide you with an export of your website files and data. Ongoing services (hosting, CRM, add-ons) will cease at the end of the billing period.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of our services constitutes acceptance of updated Terms.
